Flocality LLC, a Delaware limited liability company ("Flocality," "we," "us," "our"), operates a software-as-a-service platform (the "Service") used by independent service Operators to manage their business operations, accept bookings, and process payments.

Flocality's only customer is the Operator. Operators run independent businesses and have their own obligations to the people they serve regarding information collected from those people. Where Flocality's software processes data about an Operator's customers, Flocality acts as a technical service provider to the Operator only.

If Flocality is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction. We will require the recipient to honor this Privacy Policy or provide comparable protections.
We may share information in other ways if you direct us to or give us explicit consent.
When people book through your Flocality page, they enter information so you can serve them — typically name, contact information, service location details, and payment information. That data belongs to your business.
The platform stores this data and makes it available to you in your dashboard. Flocality acts only as a technical service provider for that data. We do not market to, contact, or build profiles of the people who book through your page. They are not Flocality's customers; they are yours.
Payment card information from people booking through your page is tokenized and transmitted directly to Stripe. Flocality does not store full card numbers.
You are responsible for handling this data in accordance with applicable law and your own privacy obligations to the people you serve. If they have privacy-related requests about how their information is used, those requests should be directed to you. Flocality will forward such requests to you when received directly.
We retain information for as long as needed to provide the Service, meet legal obligations, resolve disputes, and enforce our agreements. Typical retention:

We use reasonable administrative, technical, and physical measures to protect information, including encryption in transit, access controls, and infrastructure hosted on Google Cloud Platform and Stripe. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential.

Most browsers let you block or delete cookies. Blocking essential cookies may prevent the Service from functioning.
We do not currently respond to "Do Not Track" browser signals, which are not standardized across browsers.
Depending on where you live (California, Virginia, Colorado, Connecticut, Utah, Texas, and other states with comprehensive privacy laws), you may have the following rights:
Send your request to support@flocality.com. We will verify your identity before fulfilling the request and will respond within the time required by applicable law (generally 45 days). If your request relates to information held by an Operator about you, we will forward the request to the Operator, who is the party primarily responsible for responding.
You may designate an authorized agent to submit a request. We may require proof of the agent's authorization and verification of your identity.
The Service is not intended for children under 18, and the Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact support@flocality.com and we will delete it.
The Service is intended for use in the United States only. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Your information will be processed in the United States.
When Operators sign up at flocality.com/signup.html and provide a mobile phone number, Flocality collects and stores that number to send transactional SMS notifications about booking activity, subscription billing, payout status, and account events. The SMS messaging program, frequency, opt-out instructions, and applicable rates are described in our Terms of Service.
Flocality uses Twilio Inc. as its SMS service provider. Phone numbers and SMS message metadata may be processed by Twilio solely for the purpose of delivering messages on Flocality's behalf. Twilio is contractually bound to use this data only for service delivery. See Twilio's privacy practices at twilio.com/legal/privacy.
SMS opt-in data is not sold or shared with any third party for marketing purposes. Mobile information collected through SMS opt-in (including phone numbers and consent records) is excluded from any data sharing with third parties for their own marketing or promotional purposes. This exclusion applies regardless of any other data sharing described in this Privacy Policy.
Operators may opt out of SMS at any time by replying STOP to any Flocality message, or by contacting support@flocality.com. Opting out of SMS does not cancel a Flocality subscription.
The Service may contain links to websites or services not operated by Flocality. This Privacy Policy does not apply to those third parties. Review their privacy policies before providing information.
We may update this Privacy Policy from time to time. When we make material changes, we will post the updated version here and update the "Last Updated" date. For significant changes, we will provide additional notice (such as an email to Operators or a notice within the Service). Continued use of the Service after the changes take effect means you accept the updated policy.
