Flocality is software. You pay us a monthly subscription. You get a booking page, payment processing, and a business dashboard. You run your business — we don't. What you do, how you do it, and who you serve is entirely yours. We're a tool, like Shopify or Squarespace.

What Flocality Is

Flocality LLC, a Delaware limited liability company ("Flocality," "we," "us"), operates a software-as-a-service platform that gives independent service providers ("Operators," "you") business tools including a customizable booking page, payment processing integration via Stripe Connect, scheduling, messaging, and a business dashboard.

Flocality is software. Flocality is not a service provider in any category. Operators using Flocality run their own independent businesses, set their own prices, decide their own hours, serve their own end users, and operate under their own legal and regulatory authority. Operators are not employees, agents, partners, or representatives of Flocality.

Flocality has no relationship with the people Operators serve through the platform. Those people are the Operator's customers, not Flocality's. Flocality's only customer is the Operator.

Your Account

You must be at least 18 years old and legally able to enter into a binding contract.

You agree to provide accurate information when registering and to keep it current. You are responsible for the security of your account credentials and for all activity under your account. Notify us if you suspect unauthorized access.

One account per Operator. You may not share, transfer, or resell access to your account.

Subscription & Billing

Flocality is a monthly subscription at $49.99 per month, billed in advance.

New Operators may receive a free trial of 30 days. At the end of the trial, your payment method is charged the monthly subscription fee and recurring monthly billing begins, unless you cancel before the trial ends.

Subscriptions renew automatically. You authorize Flocality (through our payment processor) to charge your payment method on file each billing cycle until you cancel.

Flocality does not take a percentage of your revenue. Our only charge to you is the monthly subscription fee.

Price changes. We may change the subscription price with at least 30 days' notice. If you don't accept a price change, you may cancel before it takes effect.

No refunds. Subscription fees are non-refundable. If you cancel, your subscription remains active through the end of the current billing period.

Failed payments. If we cannot charge your payment method, we may suspend or terminate your account until payment is current.

Payments (Stripe Connect)

Payments collected through your Flocality booking page are processed through Stripe Connect. To accept payments through Flocality, you must create and maintain a Stripe Connect account and agree to Stripe's terms (stripe.com/legal/ssa).

Funds go directly from the person making the payment to your Stripe Connect account — not to Flocality. Stripe deposits your earnings to your linked bank account on Stripe's standard payout schedule. Flocality does not hold, route, or touch your money.

Stripe charges its own processing fees on each transaction. These are set by Stripe and deducted by Stripe.

Refunds, chargebacks, payment disputes, and 1099-K reporting are handled by Stripe and are between you, the payer, and Stripe. Flocality is not a party to those transactions and does not issue refunds or resolve disputes on your behalf.

You are solely responsible for any taxes on the income you receive through your business, including reporting and remittance.

We Don't Vet Operators

Flocality does not conduct background checks, criminal history checks, credential verification, license verification, insurance verification, references, or any other screening of Operators. We verify only the basic information needed to set up an account.

People who book through your Flocality page are doing business with you, not with Flocality. We make no representation or warranty regarding the qualifications, credentials, identity, character, fitness, or reliability of any Operator using the platform.

Acceptable Use

You agree not to use Flocality to:

We may suspend or terminate your account if we reasonably believe you have violated these terms.

Termination

You may cancel your subscription at any time from your dashboard or by emailing support@flocality.com. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account if you violate these terms, fail to pay, or expose Flocality to legal or operational risk. We may terminate immediately and without refund in cases of fraud, abuse, or serious violation.

We may discontinue the service entirely with at least 30 days' notice and a refund of any prepaid subscription amount covering days after shutdown.

When your subscription ends, your account is deactivated. Your Stripe Connect account is owned by you, and payouts from previously completed transactions continue per Stripe's schedule.

Disclaimers & Limitation of Liability

The service is provided "as is." Flocality is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the service will be error-free, secure, or always available.

We are not responsible for your business. Flocality is not responsible for, and disclaims any liability arising from, the services you provide to the people you serve, including any acts, omissions, accidents, injuries, property damage, complaints, disputes, regulatory issues, or other consequences of your independent business.

Third-party services. Flocality integrates with third-party services including Stripe, Twilio, Firebase, Google, and others. We are not responsible for outages, errors, or actions of these third parties.

Limitation of liability. To the maximum extent permitted by law, Flocality's total liability to you for any claim arising out of or relating to these terms shall not exceed the greater of (a) one hundred U.S. dollars ($100), or (b) the total subscription fees you paid Flocality in the twelve (12) months preceding the claim. Flocality is not liable for indirect, incidental, special, consequential, or punitive damages.

Indemnification

You agree to defend, indemnify, and hold harmless Flocality LLC, its officers, members, and employees from any third-party claim arising out of (a) your violation of these terms, (b) your violation of applicable law, or (c) your infringement of any third-party right.

This does not extend to claims arising solely from Flocality's own gross negligence or willful misconduct.

Privacy

This Privacy Policy describes information we collect from Operators using Flocality.

What we collect:

Data the platform handles for you. When people book through your Flocality page, they enter information so you can serve them. That data belongs to your business. It is stored in our system and made available to you in your dashboard. We act only as a technical service provider to you for that data. We do not market to, contact, or build profiles of the people who book through your page. They are not Flocality's customers; they are yours.

How we use your information:

Who we share with. We share information with third-party service providers as necessary to operate the platform: Stripe (payments), Twilio (messaging), Firebase / Google Cloud (data and hosting), Google Maps (geocoding), Zapier (workflow automation). Each provider has its own privacy practices.

What we don't do. We do not sell your personal information, share it with advertisers, or use it for targeted advertising. We do not store your full payment card number.

Data retention. We retain your account information for as long as your account is active and for a reasonable period afterward for legal and accounting purposes. You may request deletion by emailing support@flocality.com.

Your rights. Depending on where you live, you may have rights under applicable privacy laws (access, correction, deletion). To exercise them, email support@flocality.com.

Children. Flocality is intended only for users 18 and older. We do not knowingly collect information from anyone under 18.

Security. We use commercially reasonable security practices. No system is perfectly secure. If a data breach affects you, we will notify you in accordance with applicable law.

SMS Communications

Program name: Flocality Operator Notifications

Description. By creating an account at flocality.com, you consent to receive operational and transactional SMS from Flocality at the mobile phone number you provide. Messages include: (1) account verification login codes, (2) booking notifications when a customer submits a booking on your branded booking page, (3) subscription billing notices, (4) payment failure alerts, and (5) Stripe payout activation notifications. All messages are transactional service messages necessary for operating the platform. We do not send marketing or promotional SMS.

Message frequency. Message frequency varies based on account activity. Typical frequency is 0–20 messages per month.

Message and data rates. Message and data rates may apply. Check with your wireless carrier for details. Flocality does not charge for SMS.

Opt-out (STOP). You may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any Flocality message. After opting out, you will receive one final message confirming you have been unsubscribed. Opting out will disable booking notifications, billing alerts, and other operational messages, which may impair your ability to use Flocality. To resubscribe, reply START or SUBSCRIBE.

Help (HELP). For help, reply HELP to any Flocality message, or email support@flocality.com.

Compliance. Flocality's SMS to Operators is operated under registered A2P 10DLC compliance with our SMS provider, Twilio Inc. Mobile phone numbers and SMS opt-in data collected by Flocality are not sold or shared with third parties for marketing purposes.

Changes to These Terms

We may modify these terms at any time. For material changes, we will provide at least 14 days' notice by email or in-app notification. Continued use after the effective date constitutes acceptance. If you don't accept the updated terms, you may cancel your subscription.
